Company Policy & Terms and Conditions

Website use, programme enrolment, service delivery and partner obligations

Legal Entity
ChessCurve School of Excellence Private Limited

Brand scope: This document applies specifically to ChessCurve. Customer and grievance requests for this brand must use admin@chesscurve.com.

01

Purpose and scope

This document governs use of the relevant brand website, enquiries, registration, enrolment, online classes, learning platforms, assessments, events and related services supplied by ChessCurve School of Excellence Private Limited (the “Company”). It applies only to the brand named on this document.

Programme-specific information shown on the programme page, checkout screen, accepted quotation, enrolment confirmation or signed agreement forms part of the contract. Before payment, the Company should clearly state the programme, fees, taxes, duration, delivery format, included sessions/features and applicable refund terms.

02

Acceptance and minors

By registering, paying for, or using a paid programme, the customer accepts these terms. A parent or lawful guardian must complete enrolment and provide any consent required for a learner under 18. The parent/guardian is responsible for accurate information, payment authorisation and reasonable supervision of the learner.

The Company will not treat a child’s use of a website as a substitute for any parental consent required by applicable law.

03

Program delivery

The program may include live classes, practice tasks, learning resources, assessments, progress reports, tournaments, certificates or other features only where included in the programme description or written confirmation.

Class times, coaches, batches or platforms may be reasonably changed for availability, safety, technical issues, holidays or operational needs. Material changes or a material inability to deliver will be addressed under the applicable cancellation/refund policy.

Educational outcomes, chess ratings, competition ranks, examination results, admissions or career outcomes are not guaranteed unless a specific written guarantee is expressly offered.

04

Registration, conduct and access

Users must provide accurate contact and enrolment details, protect passwords and class links, attend on time, communicate respectfully and follow reasonable safety and platform instructions.

Users must not harass, threaten or discriminate against others, share another learner’s personal data, record or redistribute classes without permission, share paid accounts, copy or resell materials, disrupt a class, or use the website for unlawful activity.

The Company may restrict access proportionately for non-payment, fraud, security risk, serious misconduct or material breach and it may take legal action if it is required. Any refund consequence remains subject to the published refund policy and applicable law.

05

Fees, payments and invoices

Fees, discounts, instalments, taxes, validity and inclusions must be disclosed before payment. Payments must be made through authorised channels. Purchase consent must be affirmative and must not rely solely on a pre-ticked option.

The Company may issue invoices/receipts using the billing details supplied. Failed, duplicate or incorrect payments should be reported with transaction references. The Company will investigate and arrange an appropriate correction where validated.

Third-party payment providers may have their own technical terms. These do not remove any mandatory consumer rights.

06

Intellectual property and technology

Brand assets, curriculum, lesson plans, chess puzzles, code, worksheets, assessments, videos, recordings, platform content and other materials are owned by or licensed to the Company or the relevant rights holder.

Users receive a limited, personal, non-transferable right to use purchased materials for the programme period. Copying, public posting, commercial resale, unauthorised recording, scraping or reverse engineering is prohibited unless written permission is given.

AI-enabled tools, where offered, are learning aids and may make errors. Learners should not submit unnecessary personal or confidential information into third-party tools and must follow academic-integrity instructions.

07

Schools, colleges, vendors and suppliers

The Company may engage with schools, colleges, educational institutions, coaches, curriculum developers, technology vendors, suppliers, payment providers and other partners. Commercial scope should be documented in a signed agreement, accepted purchase order or written statement of work.

Such documents should identify deliverables, timetable, service levels, fees/taxes, invoicing/payment milestones, acceptance criteria, contacts, confidentiality, intellectual property rights, child safeguarding, personal-data handling, permitted brand use, termination and dispute escalation.

Schools/colleges must confirm their authority to engage the Company, designate a coordinator, provide agreed facilities/connectivity and handle any consent or student-data duties assigned to them by law or contract. The Company remains responsible for the services it has agreed to provide.

Vendors and suppliers must meet agreed specifications and timelines, issue accurate invoices, protect confidential information and personal data, follow applicable law, disclose material service interruptions or security incidents promptly and not use learner data or brand assets for their own marketing without written authorisation.

Unless expressly agreed in writing, these website terms do not create an employment relationship, agency, exclusivity, partnership or guaranteed volume of business with a school, college, coach, vendor or supplier. Signed commercial agreements govern B2B disputes.

08

Privacy, child safety and recordings

The Company will process personal data for purposes such as enquiries, enrolment, service delivery, payments, learner progress, support, safeguarding, security and legal compliance. Access should be limited to authorised persons with a business need.

Child-data processing and parental consent will be handled in accordance with applicable data-protection law and its effective commencement provisions. Optional promotional use of a child’s photograph, testimonial or recording should be treated separately from consent to receive the service.

If classes are recorded, the purpose, access and retention approach should be disclosed. Users should promptly report suspected harassment, unsafe contact, unauthorised recording or data incidents through the brand-specific contact.

09

Disclaimers and consumer rights

The Company will use reasonable care to provide the advertised service but cannot guarantee uninterrupted operation of third-party platforms or internet connections outside its reasonable control.

Nothing in these terms excludes, restricts or waives a consumer right, remedy or liability that cannot lawfully be excluded. The Consumer Protection Act, 2019 and applicable rules remain relevant to covered transactions.

10

Suspension, termination and changes

Customers may request cancellation using the brand-specific email, providing the customer/learner name, registered contact, enrolment/order ID and programme. The Company may suspend or terminate access for material breach, unlawful use, non-payment, security or safeguarding concerns, subject to applicable law.

Updates to these terms will ordinarily apply to future purchases. The version in force at the time of purchase will normally govern that purchase, subject to mandatory law and any written variation agreed with the customer.

11

Governing law and disputes

These terms are governed by Indian law. Parties should first use the brand-specific grievance process where appropriate. Nothing prevents a consumer from approaching a competent consumer commission, regulator or other statutory forum. Any jurisdiction clause must not take away a forum or right that mandatory law provides.
